Workshop: ‘Fair Use’ - Filmmaker's right to Use copyrighted Material

Too often documentary filmmakers ability to communicate effectively is restricted by an overly rigid approach to copyright compliance. Copyrighted archive is often prohibitively expensive.

The two-day workshop conducted by leading global experts from the USA and South Africa will show how South African filmmakers can use and expand users’ rights under South Africa’s copyright law.

These are rights to use copyrighted material in the creation of new works without license from the copyright holder under certain circumstances.  

 

The project points to a concrete solution – that filmmakers have rights that we can learn to use. This workshop will show how South African filmmakers can move towards achieving the basic principles in law to which ‘Fair Use’ applies and how these can be achieved in a similar way to what has been achieved in the USA.

From this workshop we aim to start a movement to adopt 'Fair Use' best Practices as done in the USA - whereby in time, it may enable Documentary filmmakers to access copyrighted material (Archive, music, photos) at no cost provided it's used fairly

 

 

Target Audience

 

The target audience for this event is primarily documentary filmmakers:

Producers, directors, writers and journalist. However we encourage Producers of ALL genres to attend.

This seminar will demonstrate that the SABC eminent decrease in local productions (Crisis) does not spell the end of filmmaking for young producers - It's not all doom and gloom as perceived by many filmmakers and in fact, there may be some hope. It is possible to make films without the contribution of the SABC. Even where the SABC is the corner stone financier, filmmakers need to know how to bring more value into the productions.

The aim for this seminar is to introduce young producers to fundraising:

  • sensitise producers to possibilities of alternative financial/funding models,
  • show ways to make filmmaking a sustainable business,
  • provide information that producers can put to use immediately 

This seminar will cover:

  • How and what is required to access other government funding i.e. NFVF, DTI, IDC, and SARS 24F (Kevin Fleischer)
  • What international funding is available and how to access it - How to use film festivals and Markets most effectively  (Dezi Rorich)
  • Sponsorship - how you go about acquiring it, at which stage of the production, and how that works with the different broadcaster (Preean Armugan)
  • Other funding models

Did you know that the DTI and IDC require companies to comply with BBBEE requirements even if they have BEE status?
  • Are you a company owned and managed by women and want to know what BEE and BBBEE credentials / opportunities/ advantages that this gives you and your company?
  • Is your film company BEE or BBBEE compliant and how to make it so?
  • Or perhaps you have no BEE credentials but want to discover exemptions and process to obtain BEE certification even if you are a 'White owned company"?
  • You are a Black owned and managed company or BEE compliant through other means such as a BEE exemption, but still need to show Broad Based Black Economic Empowerment BBBEE credentials to the DTI or similar organisations and don't know how to do this?
Compliance and even getting exemption can seem like a really daunting process, and yet there are advantages to knowing how the system works and how to use it to your best advantage! - what is involved and what needs to be done ?

  3. What is Enterprise Development?
  4. Who qualifies as an ED Beneficiary?
  5. What are the benefits?
  6. How to position yourself as an ED Beneficiary
  7. How to position yourself as a supplier of goods and services
  8. Getting a scorecard
About the Facilitators - Enterpriseroom
Enterpriseroom focuses on three main activities:
  • Helping smaller companies improve their businesses by developing strategies to access B-BBEE benefits, and matching them to the needs of our larger corporate clients. We call them our “Enterprise Promotion Partners” (Small, black-owned companies can be both qualifying enterprise development beneficiaries and B-BBEE suppliers, which becomes a huge incentive for large corporates to procure from them, and assist them in reducing their operational costs).
  • Working with large corporations in developing strategies for improvement of their B-BBEE Scorecard, with special emphasis on Preferential Procurement and Enterprise Development
  • Training of small black owned businesses on the benefits presented by the Codes of Good Practice on B-BBEE, and coaching those businesses in repositioning themselves and approaching customers.
